Terms and conditions

Who you are dealing with

Palate: Wine Journal ("Palate", "we", "us") is operated by PalateDigital Ltd, trading as Palate Digital, a company registered in England and Wales with company number 17481555, whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. When you use Palate or buy a credit pack you are entering an agreement with us. Questions about these terms go to dd@palatedigital.com.

What Palate is

Palate is a private tasting journal. It helps you record what you drink, keep a note of what you own and read about grape varieties. Palate does not sell, supply or ship wine. Where a wine club is mentioned, that is a separate business with its own terms.

Accepting these terms

By creating an account or continuing to use Palate you accept these terms and the privacy notice. You must be 18 or over, and you confirm your age when you sign up. If you do not accept the terms, please stop using the app.

Your account is personal to you

An account belongs to one adult and may only be used by that person. Keep your sign-in details to yourself and do not share them with anyone — including a partner, a family member or anyone else in your household. Every adult who wants to use Palate needs their own account. This is not simply a commercial rule: we confirm one date of birth per account, we record one person's acceptance of these terms and the privacy notice, and we can only answer a request to see, correct or erase data for an identifiable individual. Anything done through your account is treated as done by you. Give us accurate information, keep it up to date, and tell us promptly if you think someone else has access to your account. We may suspend an account that is being shared.

How you may and may not use Palate

You may use Palate for your own personal wine record-keeping, within the plan you are on. You must not:

  • · break the law, or use Palate to help anyone else do so
  • · upload anything unlawful, abusive or infringing, or any photograph that is not of wine — photographs are screened automatically and unsuitable images are refused and may be reported
  • · copy tasting notes or other text you do not have the right to publish
  • · scrape, probe, overload or reverse engineer the app, or work around usage limits
  • · resell or redistribute access to Palate

Your content, and sharing it

Your tastings, notes and photographs remain yours. You give us only the permission we need to store, process and display them so the app works for you, including generating a shareable tasting card at your request. Tasting notes are personal opinions based on your own experience of a particular bottle; you are responsible for what you write and for anything you choose to publish outside the app. We may remove content that is unlawful or abusive.

Features that use artificial intelligence

Label scanning, drafted tasting notes, voice input and spoken readings are produced by automated systems and can be wrong. Always check the detail before you rely on it, and treat drafted notes as a starting point for your own words rather than a statement of fact about a wine.

Our intellectual property

The app, its design, its written guides and the Palate name remain ours. You get a limited, personal, non-transferable right to use Palate under these terms; nothing here transfers ownership of anything.

Availability

We work to keep Palate running, but we do not promise it will be uninterrupted or free of faults. Features may change, and we may withdraw or replace parts of the app.

Payment and subscriptions

Palate Extras credit packs are sold through Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, tax, renewals, cancellation and refunds are governed by Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms and by our own refund policy. Subscriptions renew until cancelled; cancelling stops the next renewal and you keep access to the end of the period you have already paid for. Plan changes are pro-rated immediately.

Gifts

Palate credits can be bought as a gift. A gift is a single payment for a fixed number of credits: it does not renew, no card is stored for the recipient, and nothing is charged to them. The buyer receives a one-use code to pass on. A code has no cash value, cannot be exchanged for money and can only be redeemed once, by a Palate account holder aged 18 or over. Redeemed credits are added to the recipient's balance and never expire. Refunds for a gift are requested by the person who paid for it, on the same terms as any other purchase; once a code has been redeemed, the credits it granted cannot be refunded.

Suspending or closing your account

We may suspend or close an account for a serious or repeated breach of these terms, for non-payment, or where there is a security or fraud risk. You can close your account at any time from your profile. When an account is closed your data is erased on the timetable set out in the privacy notice, apart from records we are required by law to keep.

Wine guidance

Drinking windows, pairings, tasting guidance and other wine suggestions in Palate are editorial opinion, drawn where possible from producers and published notes. They are not a guarantee of how any bottle will taste or age: that depends on storage, closure, transport and condition, which we cannot see. Use your own judgement when opening a bottle.

Liability

Nothing here limits liability for fraud, or for death or personal injury caused by negligence, or anything else that cannot be limited by law. Otherwise, we are not liable for indirect or consequential loss, including lost profit, lost data or lost goodwill, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Law and disputes

These terms are governed by the law of England and Wales, and disputes are for the courts of England and Wales. If any part of these terms cannot be enforced, the rest continues to apply.

Changes to these terms

If we change these terms materially we will say so in the app before the change takes effect. Continuing to use Palate afterwards means you accept the new version.
